NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder at the West Main Entrance, Garfield County Courthouse, 55 South Main, Panguitch, Utah, on April 19, 2013, at 11:00 a.m. of said day, for the purpose of foreclosing a trust deed originally executed on April 24, 2006 by Michael L. Abrams and Theresa M. Abrams, Husband and Wife, as trustors, in favor of National City Mortgage a division of National City Bank of Indiana, covering the following real property purported to be located in Garfield County at 4 A Mammoth View Estates, Hatch, UT 84735 (the undersigned disclaims liability for any error in the address), and more particularly described as: Parcel 1: The West half of the Southeast quarter of the Northeast quarter of Section 36, Township 36 South, Range 7 West, Salt Lake Base and Meridian. Also described as Lot 5A MAMMOTH VIEW RANCH. Excepting therefrom all oil, gas and/or other minerals, in, on or under said land, together with the right of ingress and egress for the purpose of exploring and/or removing the same. Together with an Easement for the purpose of ingress and egress to and from the herein described property traversing from the South to North along an existing road in the East half of the East half of Section 1, Township 37 South, Range 7 West , Salt Lake Base and Meridian and traversing from East to West along an existing road in the North half of the Northeast quarter of Section 7, Township 37 South, Range 6 West, Salt Lake Base and Meridian as set forth in those certain Quit Claim Deeds recorded December 19, 1991 as Entry Numbers 205616 and 205617. Subject to and together with the following Easements for ingress and egress: An Easement over and across an existing roadway traversing from South to North located in the East half of the East half of Section 36, Township 36 South, Range 7 West, Salt Lake Base and Meridian as evidenced by U.S. Geological Survey Map "Panguitch Lake" #N3730-W11230/15. Also, an Easement which is contiguous with and abutting the aforementioned existing roadway in said Section 36, being 50.0 feet in width, for ingress and egress, the centerline of which is described as follows: Beginning at a point on the Westerly line of said existing roadway at a point approximately 660.0 feet West and 25.0 feet North of the Southeast corner of the said Section 36; thence West 660.0 feet, more or less, parallel to the South Section line, to the 1/16th line; thence North along the 1/16th line 1295.0 feet, more or less, to the Northwest corner of the Southeast quarter of the Southeast quarter of said Section 36 and the Point of Ending. Also, an Easement which is contiguous with and abutting the Westerly line of the aforementioned existing roadway in said Section 36, being 50.0 feet in width for ingress and egress, the center line of which is described as follows: Beginning at a point on the Westerly line of said existing roadway at approximately the Southeast corner of the Northeast quarter of the Southwest quarter of the Northeast quarter of said Section 36; thence West 660.0 feet, more or less, of the Southwest quarter of the Northeast quarter of the Southwest quarter of the Northeast quarter and the point of ending. Also, an Easement which is contiguous with and abutting the Westerly line of the aforementioned existing roadway in said Section 36, being 50.0 feet in width for ingress and egress, the centerline of which is described as follows: Beginning at a point on the Westerly line of said existing roadway at a point 660.00 feet West, more or less, from the East quarter corner of said Section 36; thence West 1980.0 feet, more or less along the center Section line to the center of said Section 36; thence South 2640.0 feet, more or less, to the South quarter corner of said Section 36 and the point of ending. Also, an Easement which is 50.0 feet in width for ingress and egress, the centerline of which is described as follows: Beginning at the center of said Section 36; thence West 1320.0 feet, more or less to the Northwest corner of the Northeast quarter of the Southwest quarter of said Section 36; thence South along the 1/16th line 2640.0 feet, more or less to the South Section line of said Section 36 and the point of ending. Also an Easement which is 50.0 feet in width for ingress and egress, the centerline of which is described as follows: Beginning at the Southwest corner of the Southeast quarter of the Northwest quarter of said Section 36; thence North 1980.0 feet, more or less along the 1/16th line to the Southwest corner of the Northwest quarter of the Northeast quarter of the Northwest quarter of said Section 36; thence East 660.0 feet, more or less to the Southeast corner of the Northwest quarter of the Northeast quarter of the Northwest quarter of said Section 36 and the Point of Ending. Also, an Easement which is 50.0 feet in width for ingress and egress, the centerline of which is described as follows: Beginning at the Northeast corner of the Southwest quarter of the Northwest quarter of said Section 36; thence West 1295.0 feet, more or less along the 1/16th line to a point 25.0 feet East, more or less from the Northwest corner of the Southwest quarter of the Northwest quarter of said Section 36; thence South 3960.0 feet, more or less parallel to the West Section line to a point 25.0 feet East of the Southwest corner of said Section 36 and the point of ending. Subject to an Easement for roadways over and across the herein described property as the same now exist. Parcel 2: The East half of the Southeast quarter of the Northeast quarter of Section 36, Township 36 South, Range 7 West, Salt Lake Base and Meridian. Also described as Lot 4 MAMMOTH VIEW RANCH. Excepting therefrom all oil, gas and/or other minerals, in, on or under said land, together with the right of ingress and egress for the purpose of exploring and/or removing the same. Together with an Easement for the purpose of ingress and egress to and from the herein described property traversing from the South to North along an existing road in the East half of the East half of Section 1, Township 37 South, Range 7 West , Salt Lake Base and Meridian and traversing from East to West along an existing road in the North half of the Northeast quarter of Section 7, Township 37 South, Range 6 West, Salt Lake Base and Meridian as set forth in those certain Quit Claim Deeds recorded December 19, 1991 as Entry Numbers 205616 and 205617. Also, an Easement which is 50.0 feet in width for ingress and egress, the centerline of which is described as follows: Beginning at the Northeast corner of the Southwest quarter of the Northwest quarter of said Section 36; thence West 1295.0 feet, more or less along the 1/16th line to a point 25.0 feet East, more or less from the Northwest corner of the Southwest quarter of the Northwest quarter of said Section 36; thence South 3960.0 feet, more or less parallel to the West Section line to a point 25.0 feet East of the Southwest corner of said Section 36 and the point of ending. Subject to an Easement for roadways over and across the herein described property as the same now exist. Subject to an Easement for utilities, 7.5 feet in width, along all perimeter boundaries of the herein described property. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: WR-550-5 The current beneficiary of the trust deed is PNC Bank, National Association and the record owners of the property as of the recording of the notice of default are Michael L. Abrams and Theresa M. Abrams, husband and wife as joint tenants. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
