STATEMENT OF LIEN AND INTENT TO DISPOSE OF LIEN PROPERTY TO ALL WHOM IT MAY CONCERN: Salt Lake County, on behalf of its Equestrian Park, wishing to avail itself of its rights under Utah Code Ann. § 38-2-1, makes the following statement of lien and intent to dispose of lien property: FIRST, Salt Lake County currently stables a bay colored horse approximately 4 years old in stall 406, Barn 400, at the Salt Lake County Equestrian Park, located at 10800 South 2200 West, South Jordan, Utah 84095 (hereinafter referred to as the "Horse"). SECOND, that the name and mailing address of the owner, or reputed owner, of the Horse to be charged with the lien is: Juan Manuel Cortes Castanedo 2945 South Flair Street West Valley City, Utah 84120 THIRD, that Salt Lake County on behalf of its Equestrian Park, located at 10800 South 2200 West, South Jordan, Utah 84095, claims a lien on the Horse for feeding pursuant to Utah Code Ann. § 38-2-1 (1953), and for labor and storage fees associated with stabling the Horse pursuant to Utah Code Ann. § 38-2-4(2)(b)(iv). FOURTH, that the amount of indebtedness due and owing Salt Lake County, together with collection costs and attorney fees and interest thereon at the legal rate of 10% per annum through the date of the sale listed, which would be sufficient to redeem the property from the lien claimed, is $725.00 FIFTH, that the Horse is being sold to satisfy a lien, pursuant to Utah Code Ann. §§ 38-2-1 and 38-2-4. SIXTH, that the proposed private sale of the Horse shall be conducted on the 22 day of April, 2013, at 11 am and at front office at the Equestrian Park, located at 2100 West 11400 South, South Jordan, Utah 84095. SEVENTH, that the owner has the right to recover possession of the property without instituting judicial proceedings by posting a case or surety bond with the clerk of a justice or district court, made payable to Salt Lake County, and conditioned for the payment of any judgment that may be recovered on the lien, with costs, interest, and storage fees. EIGHTH, that if payment in full is not received within prior to the scheduled sale, Salt Lake County intends to proceed with the sale of the Horse pursuant to the notice of proposed private sale, contained herein, and as required in Section 38-2-4 of Utah Code Annotated. NINTH, that upon sale of the horse, neither Salt Lake County nor its Equestrian Park offers any warranty relating to title, possession, quiet enjoyment, or the like in this disposition, and that the sale is conducted "as-is, where-is." TENTH, that Juan Manuel Cortes Casanedo may at any time prior to the sale redeem the Horse from the lien by paying the amount claimed by Salt Lake County. Utah Code Ann. § 38-2-4(7).
