NOTICE OF TRUSTEE'S SALE (For Reference Only: Parcell.D. Nos. 17-042-0084 and 17-042-0066) The following described propetty will be sold at public auction to the highest bidder, payable in lawful money of the United States, outside the front entrance to the Utah County-Fomth District Cout1 located at 125 North 100 West, Provo, Utah 84601, on Tuesday, April 30, 2013, at 1:00 p.m., to foreclose a Deed of Trust, Security Agreement and Financing Statement dated June 16,2006, executed by Nationwide Life Insurance Company, as "Lender", in favor of M. Lawrence Hicks, Jr. as "Trustee", for the benefit of Portofino, LLC, as "Borrower", and recorded on June 16, 2006 as Entry No. 75809:2006 in the office of the Utah County Recorder, State ofUtah (the "Trust Deed"). The Trust Deed covers certain property situated in Utah County, State of Utah, more particularly described in Exhibit "A" attached hereto and incorporated herein by this reference (the "Property"). A Notice of Default and Election to Sell was recorded with the Utah County Recorder on April24, 2012, as Entry No. 33276:2012. The beneficial interest under the Trust Deed is currently held by U.S. Bank National Association, as Trustee, as successor in interest to Bank of America, National Association, as successor by merger to LaSalle Bank National Association, as Trustee for the registered holders of Bear Sterns Commercial Mortgage Securities Inc., Commercial Mottgage Pass-Through Certificates, 2006-PWR13. The record owner of the Propetty as of the recording of the Notice of Default was Portofino, LLC (the "Beneficiary"). The Trustee will sell the Property as is and where is at the time of sale without warranty, express or implied. Bidders must tender to the Trustee a $5,000 deposit at or before the sale and the balance of the purchase price within 24 hours following the sale. The deposit must be in the form of a wire transfer, cashier's check, or cettified funds payable to Parr Brown Gee & Loveless on behalf of the Beneficiary.
