NOTICE OF TRUSTEE'S SALE The following property will be sold to the highest bidder at a public auction at the main entrance of the Wasatch County Courthouse, 1361 South Highway 40, Heber City, Utah, on February 13, 2013 at 9:00 a.m., to foreclose a Trust Deed recorded August 17, 2010 as Entry No. 361766 (and amended by an Affidavit recorded July 18, 2012 as Entry No. 380616), executed by Greg Mullins, as Trustor, in favor of Mortgage Electronic Registration Systems, Inc., as nominee for Paramount Equity Mortgage, Inc., a California Corporation, and its successors and assigns, covering real property in Wasatch County (Tax/Parcel No. 2-9061) purportedly, but not guaranteed to be located at 2588 S. White Pine Drive, Heber City, Utah 84032, together with, and subject to, any applicable improvements, fixtures, easements, appurtenances, taxes, assessments, conditions, covenants, restrictions, reservations or other enforceable rights and obligations, and described as follows: Lot 623, TIMBERLAKES, SUBDIVISIO, Plat No. 6, according to the Official Plat thereof on file and of record in the Wasatch County Recorder's Office. Apparently more correctly described as: Lot 623, TIMBER LAKES, SUBDIVISION, Plat No. 6, according to the Official Plat thereof on file and of record in the Wasatch County Recorder's Office. Being the same property as described in Deed Instrument No. 349876 dated 06/30/2009 and recorded 07/01/2009 Wasatch County records. The current beneficiary of the Trust Deed is Bank of America, N.A. and as of the date the Notice of Default recorded, the property was owned by Greg Mullins according to record. The successful bidder must tender a $5,000 non-refundable deposit at the sale, in the form of a cashier's/official bank check payable to the Trustee, and deliver the balance in certified funds to the Trustee's office within 24 hours of the sale; otherwise, the Trustee reserves the right to sell the property to the next highest bidder, retain the deposit, and hold the defaulting bidder liable for any additional damages. The sale is without any warranty, including title, possession and encumbrance, and is voidable by the Trustee, without any liability, for any circumstance unknown to the Trustee affecting the validity of the sale. If the Trustee voids the sale, the successful bidder's sole remedy is return of any funds tendered to the Trustee.
