NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, at the Front Steps of the Main Entrance of Washington County District Court, 206 W. Tabernacle, St. George, Utah, on August 16, 2013 at 1:00 p.m. of said day, for the purpose of foreclosing a homeowners association lien against Mervyn S. Bennion as owner, in favor of Riverwood II Townhomes Homeowners Association, covering real property located at 1165 W Indian Hills Drive # 231, St George, UT 84770 and more particularly described as: All of Lot 231, Riverwood III Townhomes, A Planned Unit Development, according to the official plat thereof, recorded in the Office of the Recorder of Washington County, State of Utah. Parcel ID No. SG-RW-3-231 Record owner of the property as of the recording of the Notice of Default is Mervyn S. Bennion. The sale is subject to a bankruptcy filing, a payoff, or any other condition of which the Trustee is not aware that would cause the cancellation of the sale. If any such condition exists, the sale shall be void, the successful bidder's funds returned and the Trustee and Association shall not be liable to the successful bidder for any damage. The sale will be made without covenant or warranty, express or implied, regarding title, possession or encumbrances. Bidders must tender to the Trustee a $5,000.00 deposit at the sale and the balance of the purchase price by 5:00 p.m. the day following the sale. The deposit and purchase price must be in the form of a cashier's check, bank official check, or U.S. Postal money order payable to Richards Kimble & Winn, PC.
