NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder at the West Foyer on West Steps, Sanpete County Courthouse, 160 North Main, Manti, Utah, on September 11, 2013, at 12:00 p.m. of said day, for the purpose of foreclosing a trust deed dated August 7, 2007 and executed by Christian E. Babinski, as trustor, in favor of Mortgage Electronic Registration Systems, Inc. as nominee for American Mortgage Network, Inc., its successors and assigns, covering the following real property purported to be located in Sanpete County at 230 East Center Street Building #3, Ephraim, UT 84627 (the undersigned disclaims liability for any error in the address), and more particularly described as: Beginning 140.25 feet South from the Northwest Corner, of Lot 3, Block 14, Plat "A", Ephraim City Survey; thence East 72.25 feet; thence South 111.75 feet; thence West 72.25 feet; thence North 111.75 feet, more or less, to the point of beginning. A non-exclusive 30 foot wide easement for egress and ingress 15 feet on each side of the following described centerline; beginning at a point 34.00 feet West from the Northeast Corner of Lot 7, Block 14, Plat "A", Ephraim City Survey; thence South 140.25 feet; thence South 50°0'00" West 44.36 feet; thence South 223.47 feet, more or less, to the point of beginning. Subject to easements, covenants conditions, restrictions, rights of way and any prior reservations of minerals appearing of record, or any other reservations of record. Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. Parcel No.: 164X1; 164X The current beneficiary of the trust deed is The Bank of New York Mellon Trustee for CSMC Trust 2011-11 and the record owner of the property as of the recording of the notice of default is Reed Call. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidder's funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier's check or bank official check payable to eTitle Insurance Agency. The balance must be in the form of a wire transfer, bank or credit union cashier's check, bank official check or U.S. Postal money order payable to eTitle Insurance Agency. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
