NOTICE OF TRUSTEE 'S SALE The following described property will be sold at public auction to the highest bidder at the Main Entrance, Uintah County Courthouse, 920 East Highway 40, Vernal, UT, on September 20, 2013 at 1:00 p.m. of said day, for the purpose of foreclosing a trust deed originally executed on February 27, 2009, as Entry No. 2009002199, Book 1131, at Pages 435-453 in the records of the Uintah County Recorder's office, State of Utah, with Deric Adams and Tamorie Adams as trustees of The Adams Family Trust dated April 22, 2006 as trustor, in favor of Celtic Bank Corporation, as beneficiary its successors and assigns, covering the following real property purported to be located in Uintah County at 2750 West Highway 40, Vernal, Utah 84078, (the undersigned disclaims liability for any error in the address), and more particularly described as: LOT l Beginning at the Southwest corner of the Southeast quarter Northeast quarter of Section 32, Township 4 South, Range 21 East, Salt Lake Base & Meridian, thence N 01° 49' 13" W along the West line of the said Southeast quarter Northeast quarter 402.39 feet;, thence S 85° 42' 58" E 287.48 feet; thence S 44° 47' 38" E 61.92 feet; thence S 32° 52' 18" E 147.62 feet; thence S 66° 47' 43" E 18.59 feet to the Western right-of-way line of U.S. Highway 40; thence Southwesterly along said right-of-way line, being a nontangent curve concave to the Southeast (having a Delta angle of 3° 35' 20", a radius of 3374.04 feet and a chord bearing of S 24° 10' 34" W) an arc distance of 211.34 feet to the South line of the Northeast quarter of said Section; thence S 87° 47' l 0" W along the said South line of the Northeast quarter 328.44 feet to the point of beginning. Basis of bearings is the North line of the Northeast quarter of said section which is calculated from the Uintah County Surveyor's control map (Titled Ashley Valley Control Survey, dated November 3, 2004) to bear N 88° 07' 32" E. Property Serial No.: 05:093:0006 Together with all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property. The current beneficiary of the trust deed is Celtic Bank Corporation and the record owner of the property as of the recording of the notice of default is Deric Adams and Tamorie Adams as trustees of The Adams Family Trust dated April 22, 2006. The sale is subject to bankruptcy filing, payoff, reinstatement or any other circumstance that would affect the validity of the sale. If any such circumstance exists, the sale shall be void, the successful bidders funds returned and the trustee and current beneficiary shall not be liable to the successful bidder for any damage. Bidders must tender to the trustee a $20,000.00 deposit at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The deposit must be in the form of a bank or credit union cashier's check or bank official check payable to Celtic Bank Corporation. The balance must be in the form of a wire transfer, bank or credit union cashier's check, bank official check or U.S. Postal money order payable to Celtic Bank Corporation. Cash payments are not accepted. A trustee's deed will be delivered to the successful bidder within three business days after receipt of the amount bid.
