NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, at the Fourth District Court, 75 East 80 North, American Fork, UT on February 15, 2013 at 11:00 a.m. of said day, for the purpose of foreclosing a homeowners association lien against Sarai R. Barahona as owner, in favor of Rock Creek Homeowners Association, covering real property located at 8215 N Clear Rock Road #2, Eagle Mountain, UT 84005 and more particularly described as: Unit 2, Building 1, contained within the Rock Creek Condominiums, as the same is identified in the record of survey map recorded on October 31, 2007 in Utah County, as Entry No. 155366:2007 (as said record of survey map may have heretofore been amended or supplemented) and in the Declaration recorded on November 05, 2002 in Utah County, as Entry No. 131939:2002 (as said Declaration may have been heretofore been amended or supplemented.) Together with the appurtenant undivided interest in said project's common areas as established in said Declaration and allowing for periodic alteration both in the magnitude of said undivided interest and in the composition of the common areas and facilities to which said interest relates. Parcel ID No. 51:505:0002 Record owner of the property as of the recording of the Notice of Default is Sarai R. Barahona. The sale is subject to a bankruptcy filing, a payoff, or any other condition of which the Trustee is not aware that would cause the cancellation of the sale. If any such condition exists, the sale shall be void, the successful bidder's funds returned and the Trustee and Association shall not be liable to the successful bidder for any damage. The sale will be made without covenant or warranty, express or implied, regarding title, possession or encumbrances. Bidders must tender to the Trustee a $5,000.00 deposit at the sale and the balance of the purchase price by 5:00 p.m. the day following the sale. The deposit and purchase price must be in the form of a cashier's check, bank official check, or U.S. Postal money order payable to Richards Kimble & Winn, PC.
