NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the East Main Entrance, Weber County Second District Courthouse, 2525 Grant Ave., Ogden, Utah, on December 17, 2013 at 11:30 AM, for the purpose of foreclosing a Trust Deed dated September 25, 2008 executed by Steve L. Mitchell II, as Trustor, in favor of Mortgage Electronic Registation Systems, Inc., as Beneficiary, covering real property located in Weber County and described as follows: THE WEST 140 FEET OF THE FOLLOWING DESCRIBED PROPERTY TO WIT, THE SOUTH 13.6 FEET OF LOT 14, ALL OF LOTS 15 AND 16 AND THE NORTH .90 FEET OF LOT 17, BLOCK 2, LAKE VIEW ADDITION, OGDEN CITY, WEBER COUNTY, UTAH, ACCORDING TO THE OFFICIAL PLAT THEREOF, THE NEW BOUNDARIES FOR SUCH AMENDED LOTS ARE DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE EAST RIGHT OF WAY LINE OF JEFFERSON AVENUE, SAID POINT BEING SOUTH 89D02'00" EAST ALONG THE CENTERLINE OF 35TH STREET 33.06 FEET AND NORTH 00D58'00" EAST 848.10 FEET FROM THE FOUND OGDEN CITY STREET MONUMENT IN THE INTERSECTION OF SAID JEFFERSON AVENUE AND 35TH STREET, THENCE NORTH 00D58'17"EAST ALONG SAID EAST LINE 64.50 FEET; THENCE SOUTH 89D01'43" EAST 140.0 FEET, THENCE SOUTH 00D58'17" WEST 64.50 FEET,THENCE NORTH 89D01'43" WEST 140.00 FEET TO THE POINT OF BEGINNING. Tax Parcel No.: 05-094-0016 The street address of the property is purported to be 3382 South Jefferson Avenue, Ogden, UT 84403. The undersigned disclaims any liability for any error in the street address. The current Beneficiary of the trust deed is Christiana Trust, a division of Wilmington Savings Fund Society, FSB, not in its individual capacity, but solely as owner trustee on behalf of RBSHD 2013-1 Trust and the record owners of the property as of the recording of this notice of default is reported to be Steve L. Mitchell II. Bidders must be prepared to tender to the Trustee $10,000.00 in the form of a cashier's check or money order(s) at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The balance may be in the form of a cashier's check, money order(s), or wire transfer. Cash and bank official checks are not acceptable. A trustee's deed will be made available to the successful bidder within three business days following receipt of the bid amount. Receipt of the bid amount being defined as the date tendered funds "clear" the Trustee's trust account. The sale is made without any warranty whatsoever, including but not limited to any warranty as to title, liens, possession, taxes, encumbrances, or condition of the property. The sale is subject to a workout reinstatement, payoff, sale cancellation or postponement, incorrect bidding instructions, bankruptcy, or any other circumstance of which the Trustee is unaware. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee, the Mortgagee's attorney, or the Trustee.
