NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, immediately outside the main entrance to the Second District Courthouse located at 425 N. Wasatch in Layton, UT on March 5, 2013, at 10:00 a.m., for the purpose of foreclosing a Deed of Trust dated February 24, 2006, originally executed by KOUROSH AND PAMELA HARONI (AS TO PARCELS 1, 2 & 5) KOUROSH HARONI AND PAMELA HARONI, HUSBAND AND WIFE, AS JOINT TENANTS, WITH FULL RIGHTS OF SURVIVORSHIP (AS TO PARCELS 3 & 4), as trustor, in favor of BARNES BANKING COMPANY as Beneficiary, covering the following described real property (common address of approx. 85 Church Street (and surrounding area), Layton, Utah 84041; parcel id nos. 10-089-0030 and -0031; and 10-070-0008, -0006, and -0005): Parcel 1: Beginning at a point 386.7 feet North of the Southwest corner of Section 21, Township 4 North, Range 1 West, Salt Lake Meridian; thence North along section line 136 5 feet; thence South 67°36' East 160.8 feet to the West right-of-way of Church Street; thence South 22°24' West along said street 80 feet; thence West 118 2 feet to the point of beginning. Less and Excepting Warranty Deed recorded November 30, 2009 as Entry No: 2496530 in Book 4910 at Page 2038 in the Office of the Davis County Recorder, State of Utah. The current beneficiary of the trust deed is WEST CRE VENTURE 2010-2, LLC and the record owners of the property as of the recording of the notice of default was Kourosh Haroni and Pamela Haroni as to parcels 1, 2 and 5, and Kourosh Haroni and Pamela Haroni, husband and wife, as joint tenant, with full rights of survivorship, as to parcels 3 and 4. Bidders must tender a $20,000.00 cashier's check payable to "McDonald Fielding, PLLC" at the sale, and balance of the purchase price in certified funds by 3:00 p.m. of the following business day. The trustee reserves the right to rescind, revoke, or void the trustee's sale after the time of the sale based upon information that the Trustee did not know at the time of the sale such as agreement between the trustor and beneficiary to postpone or cancel the sale, the reinstatement of the loan, or a bankruptcy filing.
