NOTICE OF TRUSTEE'S SALE The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the East Main Entrance, 4th Judicial District Courts Complex, 125 North 100 West, Provo, Utah, on March 5, 2013 at 9:00 AM, for the purpose of foreclosing a Trust Deed dated November 26, 2001 executed by Thomas R Cox, as Trustor, in favor of Countrywide Home Loans, Inc., as Beneficiary, covering real property located in Utah County and described as follows: COMMENCING 6 RODS EAST AND 8 RODS SOUTH OF THE NORTHWEST CORNER OF LOT 4, BLOCK 56, PLAT "A", SPANISH FORK CITY SURVEY OF BUILDING LOTS; THENCE SOUTH 4 RODS; THENCE EAST 8 RODS; THENCE NORTH 4 RODS; THENCE WEST 8 RODS TO THE PLACE OF BEGINNING. MORE CORRECTLY DESCRIBED AS: COMMENCING 4 RODS EAST AND 8 RODS SOUTH OF THE NORTHWEST CORNER OF LOT 4, BLOCK 56, PLAT "A", SPANISH FORK CITY SURVEY OF BUILDING LOTS; THENCE SOUTH 4 RODS; THENCE EAST 8 RODS; THENCE NORTH 4 RODS; THENCE WEST 8 RODS TO THE PLACE OF BEGINNING. AS CORRECTED IN AFFIDAVIT OF CORRECTION TO DEED OF TRUST RECORDED ON JUNE 7, 2011 WITH INSTRUMENT NUMBER 42077:2011 Tax Parcel No.: 07-056-0012 The street address of the property is purported to be 165 North 400 East, Spanish Fork, UT 84660. The undersigned disclaims any liability for any error in the street address. The current Beneficiary of the trust deed is Bank of America, N.A., Successor by Merger to BAC Home Loans Servicing, LP FKA Countrywide Home Loans Servicing LP and the record owners of the property as of the recording of this notice of default is reported to be Thomas R Cox. Bidders must be prepared to tender to the trustee $10,000.00 in the form of a cashier's check or money order(s) at the sale and the balance of the purchase price by 12:00 noon the day following the sale. The balance must be in the form of a cashier's check, money order(s), or wire transfer. Cash and bank official checks are not acceptable. A trustee's deed will be made available to the successful bidder within three business days following receipt of the bid amount. Receipt of the bid amount being defined as the date tendered funds "clear" the trustee's trust account.
